Not all income is created equal, especially when it comes to the tax code. Different tax rates apply to different income, so it’s important to distinguish between them and so you can form a strategy around your tax liability.
To qualify for the Opportunity Zone Program incentive an (i) individual, (ii) corporation, (iii) S-Corporation, (iv) partnership or (v) limited liability company taxpayer, must invest Capital Gains proceeds into a Qualified Opportunity Fund. Ordinary income (wages, self-employment income, bonuses and interest) are not eligible for placement into an Opportunity Fund.
Capital Gains occur when you sell a capital asset (almost everything you own and use for personal or investment purposes is a capital asset), the difference between the adjusted basis in the asset and the amount you realized from the sale is a capital gain or loss.
- Short Term Capital Gains are held less than 12 months and are taxed as Ordinary Income based on an individual’s tax filing status and adjusted gross income.
- Long Term Capital Gains are held for more than 12 months and are taxed at specific Capital Gains Tax Rates, detailed below
